It's true that the children have to be
cared for during the split up of their parents. One parent does need to
take temporary custody. Temporary custody is only temporary in the sense
that it precedes the custody case which will likely be fought in court.
Parents should make every effort to arrange the temporary custody
agreement without legal assistance. Attorneys and court are extremely
costly and will most likely be necessary later on. Initially, it is best
for the parents to settle the issue of temporary custody themselves or
with the assistance of a mediator - it will be much cheaper.
To have to negotiate with the other parent is probably the last thing
you want to do especially with regard to your children. But you really
need to be fair and reasonable at this point. It will make you look good
when the custody battle begins. Judges dislike unreasonable people.
Being reasonable will also make things as easy as possible for your
children who are already suffering from the break up of their parents.
You should know that, even for temporary custody, a child custody
evaluation may be imposed upon the parents. The best interest of the
child is, as always, what everyone should be concerned with.
The behavior of the parents will be scrutinized and bad behavior will
negatively affect the offending parent's case for temporary and
ultimately permanent custody.
But... being fair and reasonable does not mean you have to be a
pushover. You must not take temporary child custody for granted. You
need to fight hard and stand up for yourself and your kids just like you
will during the following custody hearing.

Bear in mind that the child's routine is very important and the court
does not like to disrupt it too much. That means that whoever has
temporary custody will quite likely have an advantage in a custody
battle. Why? Because the child will already be comfortable in a routine
with the parent who has temporary custody.
If you are the best choice to have custody of the children, your fight
begins with the temporary child custody decision. Do not take it lightly
because, as mentioned, temporary can turn out to be permanent.
And, it should go without saying that temporary child custody
arrangements need to be in writing, too.
