In a court room,
personal injury
cases are difficult to win because it falls under the tort lawsuit,
which the defendant allegingly claims that the plaintiff has caused
injury due to negligence. Common types of personal injury cases include
road traffic accidents, tripping, assault, accidents at work, accidents
at home, defect accidents, such as product liability, and so forth.
* Car and Vehicle Accidents - fall
under road traffic accident or traffic collision.
By law if a moving vehicle collides
with another vehicle, hits a pedestrian, building, or animal it is
considered a traffic collision or car and vehicle accident particularly
if the accident results to injury, death, or property damage. Risks are
considered in a court of law, e.g. road design, driver impairment,
speed, car design, etc.
* Dangerous products or product
liability - any product that has been manufactured and cause injury or
death, e.g. Tamiflu, Viagra, Seroquel, Vioxx, Paxil, Prozac, Symbyax,
etc.
According to the law any product that
causes injury is a dangerous product. Under the U.S. "Product Liability
Law," the courts determine who is responsible for the dangerous or
defective product. Unlike the personal injury laws, it is often easier
for the plaintiff to recover reinstitution.
* Medical malpractice - medical
malpractice falls under personal injury laws.
According to the law it is defined as
"negligence" that has been committed by a medical expert, such as a care
provider, nurse, technician, dentist, doctor, hospital, nursing home,
etc whose duties were performed that departed from common standard
practices, which are in compliance with proper experience and training.
If a medical expert departs from his common practices and it results to
injury to the patient it is considered a medical malpractice by
definition of the law.
* Toxic mold or black mold - falls
under accident and injury laws. Anyone who has been exposed to toxic
mold in their home, work environment, etc can file legal claims against
the responsible entity.
There are different claims to consider
when it comes to filing toxic mold claims. According to law, specific
claims depend on several factors including circumstance, exposure, facts
that surround the injury, etc. Responsible parties may include
contractors, subcontractors, such as general contractors, framers,
roofers, etc.
Architects, such as structural
engineers, or the entities who did not comply with the mold prevention
laws, such as land owner. Material suppliers, such as window
manufacturers, etc or previous homeowners who failed to disclose known
mold problems can become liable to compensate the injured.
Workers compensation and nursing home
abuse both fall under accident and injury laws. When negligence occurs
that causes an entity to lose his or her compensation, it causes
emotional, mental, and in some cases physical injury. Nursing home abuse
is common, and like medical malpractice suits, these cases are often
easy to win.
Finally, we consider Mesothelioma and
Asbestos. This is an extreme subject since it could fall under toxic
mold, or dangerous product laws. These conditions often develop due to
negligence caused by manufacturers who distribute toxics that cause
cancer. Both Mesothelioma and Asbestos are types of cancers.
